İşbu Kullanıcı Sözleşmesi ve Gizlilik Politikası (Bundan böyle “Sözleşme” olarak anılacaktır), SnapTate AI mobil uygulaması (Bundan böyle “Mobil Uygulama” olarak anılacaktır) kullanıcısı (Bundan böyle “Kullanıcı” olarak anılacaktır) arasında, karşılıklı olarak kabul edilerek yürürlüğe girmiştir.
Kullanıcı, Mobil Uygulama’ya giriş yaparak Sözleşme’nin tamamını okuduğunu, içeriğini bütünü ile anladığını ve tüm hükümlerini onayladığını kabul ve beyan eder.
Tanımlar
- İçerik: Mobil Uygulama’da yayınlanan veya erişimi mümkün olan her türlü bilgiyi, dosyayı, resmi, rakamı, görsel, yazınsal ve işitsel imgeleri,
- Kullanıcı: Sözleşme’nin koşullarını kabul ederek Mobil Uygulama’da yer alan İçerikler, uygulamalar ve Hizmet’ten yararlanacak medeni hakları kullanmaya ehil tüm gerçek ve tüzel kişileri,
- Sözleşme: İşbu Kullanıcı Sözleşmesi ve Gizlilik Politikası'nı,
- Taraflar: SnapTate AI ve Kullanıcı’yı,
- Mobil Uygulama: Google Play (Android), Apple App Store (iOS) ve diğer uygulama marketleri altından ulaşılabilen ve SnapTate AI’ın Sözleşme ile kapsamı belirlenen hizmetlerinin sunulduğu uygulamayı ifade eder.
Sözleşmenin Konusu ve Kapsamı
Mobil Uygulama’da mevcut olan ve ileride Kullanıcı’ya sunulacak tüm ürün, İçerik ve Hizmet’e ilişkin olarak SnapTate AI’ın ve Kullanıcılar’ın hak ve yükümlülükleri ile bu ürün ve hizmetlerden yararlanma şartlarının düzenlenmesidir. Kullanıcı işbu Sözleşme hükümlerini kabul etmekle, koşullara uygun olarak hareket edeceğini taahhüt etmektedir.
Gizlilik, Veri İşleme ve İzinler (iOS ve Android)
- Çevrimdışı Çalışma Prensibi: SnapTate AI, tamamen çevrimdışı (lokal) çalışan bir veri etiketleme aracıdır.
- İzinler: Uygulamanın temel işlevini yerine getirebilmesi için (fotoğraf çekmek ve etiketlenmiş görsel/CSV koordinat dosyalarını kaydetmek) hem Android hem de iOS cihazlarda Kamera (Camera) ve Depolama / Fotoğraflar (Storage / Photos) izinlerine ihtiyaç duyulur. Bu izinler yalnızca kullanıcının açık talebiyle alınan aksiyonlar için kullanılır.
- Veri Toplamama ve Üçüncü Taraflar: Oluşturulan tüm veriler, görseller ve CSV dosyaları yalnızca Kullanıcı'nın kendi cihazında barındırılır. SnapTate AI; hiçbir kişisel veriyi, görseli veya dosyayı internet üzerinden kendi sunucularına göndermez, depolamaz ve üçüncü şahıslarla paylaşmaz.
- Kullanıcı Takibi (Tracking) Yoktur: Uygulama içerisinde reklam kimliği (IDFA/AAID) toplanmaz, kullanıcı analitiği (analytics) veya takip (tracking) yazılımları kullanılmaz.
Taraflar’ın Hak ve Yükümlülükleri
- SnapTate AI, uygulamanın çalışması sırasında cihazda oluşabilecek arıza, veri kaybı veya işletim sistemi (iOS/Android) güncellemelerinden kaynaklı uyumsuzluklardan sorumlu değildir.
- Kullanıcı, cihazının güvenliğinden bizzat sorumludur. Tüm veriler lokal olarak tutulduğundan, dosyaların silinmesi veya üçüncü şahısların eline geçmesi durumunda sorumluluk Kullanıcı'ya aittir.
- Kullanıcı, uygulamaya ait kodları, tasarımları, ikonları ve algoritmaları kopyalamayacağını, tersine mühendislik yapmayacağını taahhüt eder. Tüm fikri mülkiyet hakları SnapTate AI'ya aittir ve ulusal/uluslararası hukuk tarafından korunmaktadır.
Sözleşmenin Feshi
SnapTate AI, uygulamanın yayından kaldırılması veya Apple App Store/Google Play politikaları gereği güncellenmesi yoluyla Sözleşme’yi tek taraflı olarak feshetme hakkını saklı tutar.
Uygulanacak Hukuk ve Yetkili Mahkeme
İşbu Sözleşme’nin uygulanmasında, yorumlanmasında ve ihtilafların çözümünde Türk Hukuku uygulanacaktır. İhtilafların hallinde, münhasıran Isparta Mahkemeleri ve İcra Daireleri yetkilidir.

SnapTate AI Mobile Application User Agreement & Privacy Policy

The Parties
This User Agreement and Privacy Policy (hereinafter referred to as the "Agreement") is entered into and mutually accepted by the user (hereinafter referred to as the "User") of the SnapTate AI mobile application (hereinafter referred to as the "Mobile Application").
By accessing and using the Mobile Application, the User acknowledges, declares, and agrees that they have read the Agreement in its entirety, fully understood its content, and approved all of its provisions.
Definitions
- Content: Any information, file, picture, figure, visual, literary, and audio image published or accessible in the Mobile Application.
- User: All real and legal persons competent to exercise civil rights who will benefit from the Contents, applications, and Services by accepting the terms of the Agreement.
- Agreement: This User Agreement and Privacy Policy.
- Parties: SnapTate AI and the User.
- Mobile Application: The application accessible via Google Play (Android), Apple App Store (iOS), and other app markets, where the services determined by SnapTate AI are offered.
Subject and Scope of the Agreement
This Agreement regulates the rights and obligations of SnapTate AI and Users, as well as the conditions for utilizing the products, Content, and Services. By accepting this Agreement, the User agrees to abide by all rules and conditions declared by SnapTate AI.
Privacy, Data Processing, and Permissions (iOS and Android)
- Offline Operation Principle: SnapTate AI is a strictly offline (local) data annotation tool.
- Permissions: To perform its core functions (capturing photos and saving annotated images and CSV coordinate files), the app requires access to the User's Camera and Storage / Photos on both Android and iOS devices. These permissions are used exclusively for actions explicitly initiated by the User.
- No Data Collection & Third Parties: All generated data, images, and CSV files are hosted entirely on the User's own device. SnapTate AI DOES NOT transmit, store, or share any personal data, images, or files with external servers or third parties.
- No Tracking or Analytics: The application does not collect advertising identifiers (IDFA/AAID) and does not use any user tracking or analytics software.
Rights and Obligations of the Parties
- SnapTate AI cannot be held responsible for device malfunctions, data loss, or incompatibilities arising from operating system (iOS/Android) updates.
- The User is personally responsible for the security of their device. Since all data is kept locally, SnapTate AI bears no responsibility if files are deleted or compromised by third parties.
- The User agrees not to copy, reproduce, reverse-engineer, or distribute the application's codes, designs, icons, or algorithms. All intellectual property rights belong to SnapTate AI and are protected by national/international law.
Termination of the Agreement
SnapTate AI reserves the right to unilaterally terminate this Agreement by removing the Application from publication or updating it in accordance with Apple App Store or Google Play policies.
Applicable Law and Jurisdiction
Turkish Law shall apply in the implementation, interpretation, and resolution of disputes arising from this Agreement. The Courts and Execution Offices of Isparta, Turkey shall have exclusive jurisdiction over any dispute.
